RE: NOTICE OF PROPOSED DELIVERY PROHIBITION

The Department has determined that violations at the above facility warrant prohibition of fuel
delivery in accordance with ADEM Administrative Code r 335-6-15-.45. Once Delivery
Prohibition is imposed, it will be illegal to deposit or accept product into any UST system at this
facility. Delivery Prohibition will be effective upon the placement of red tags on the fill pipes.
Violations were noted in a Notice of Delinquency on November 30,2020 and a Notice of Violation
on February 2,2021 for this site.
The violations are:
• failure to submit verification that the regular unleaded catchment basin(s) have been
repaired or replaced (ADEM Form 20)
• failure to submit documentation of overfill device inspections (ADEM Form 559)
• failure to submit the system's annual probe and the automatic tank gauge console test
results(ADEM Form 565).
To date,the Department has not received a response to the NOD or NOV indicating that these
violations have been corrected.
Before delivery prohibition is imposed, you have an opportunity to meet with Department staff
and present evidence to show cause why delivery prohibition should not be imposed. Please
contact Craig Hodes at (334) 271-7912 or email him at cah@adem.alabama.gov before 4:00
p.m. on April 30,2021 to let us know If you would like to meet with Department staff, or If you
wish to discuss these violations by phone. If compliance has not been demonstrated by this
time and date,thefacililywill be placed on the Department's Delivery Prohibition List and delivery
prohibition will become effective at the time red tags are placed on the fill pipes. The Delivery
Prohibition List may be accessed from the Department's website at www.adem.alebama.gov.

Due to the above noted violations,this facility maybe ineligible for coverage under the Alabama
Underground Storage Tank Trust Fund, should a release of contaminants occur before
compliance is achieved.
The Department retains the option to take further enforcement actions such as the issuance of
an Administrative Order with monetary penalties for the violations noted above.
Please be aware the December 8, 2017 ADEM UST regulation revision included a requirement
for owners/operators to provide the Department with a valid email address. Your email address
will be utilized to provide testing reminders and other helpful notifications. Please note that
owners and operators should register and confirm your email address even if you have
previously provided 9 to the Department. Please visit www.adem.alabama.covlcustard and
follow the instructions to register and confine your email address.
