All USTs with(CP)cathodic protection systems are subject to the above noted testing requirements. In Accordance to ADEM Admin Code R.335-6-15-.33,temporarily closed UST systems shall also meet these testing requirements.If you have the results of the CP system test but have not submitted them to the Department,you should submit them at this time. If you do not have the required CP system test results,within thirty(30)days of the date of this letter,you should have the CP test performed and submit the test results to the Department. Please be advised that impressed current cathodic protection systems must be continuously supplied with power. USTs with impressed current cathodic protection systems that have been without power continuously for a period greater than 12 months must either perform an internal assessment to show the structural integrity of the tanks or be permanently closed. Failure to respond to this notice may result in enforcement by the Department in accordance with ADEM Admin.Code R.335- E-15-.13.Additionally,please ensure that all other testing and maintenance at the above-referenced facility is up to date to avoid this notice being escalated to enforcement action.If any required testing or maintenance is due,please complete and submit proper documentation to the Department within thirty (30) days of this notice.Failure to respond may also result in this facility being deemed ineligible for coverage under the Alabama UST Trust Fund should a release of contaminants occur.
