Box 567 Graysville, AL 35073 RE: Railyard Activity Update Request Big Sky Environmental, LLC Solid Waste Facility Permit No. 37-48 Dear Mr. Click: On February 2. 2022, the Department issued to Big Sky Environmental, LLC (Big Sky) a Notice of Violation (NOV) for failing to update the facility's operation plan to incorporate a railyard that had been constructed within the facility's boundary. The NOV required Big Sky to "...cease and desist the operation of the railyard for the rail transportation of waste materials until such time as the permit is appropriately modified." A follow-up inspection by Department personnel on February 15, 2022, noted an additional six railcars at the railyard that had recently been received. The railcars contained waste material. Facility representatives indicated that these railcars arrived at the facility on February 13, 2022, and had been in transit to the facility prior to the issuance of the aforementioned NOV. Based on this new development at the railyard, the Department requests the following information: is Documentation of the type of material received via rail on February 13, 2022, along with the name of the generator of said material, is How the material has been or is planned to be managed at the facility, is Documentation of how and when each of the generators that send waste via rail to Big Sky were notified of the February 2nd NOV and cessation of operations of the railyard, is Documentation from the generator of the date and time of when the material in question was shipped to Big Sky, • Documentation of how and when Big Sky was notified that the shipment from the generator was inbound, • A detailed timeline and route for the transportation of this material from the generator to the landfill (including any periods of"storage" or "temporary stoppage" of the material along t te), Birmingham Branch Deca i-Branch Mobile Branch MoblleLomWl 110 Vulcan Road 27155antliin Read,S W, 2204 Perimeter Read 4171 Lommantlers)me Birmingham,AL 35209-4702 Decatur,AL 3%03-1333 Mollie,AL 36615-1131 Mobile.Al- 36615-1421 (205)W2E188 (2561353-1713 (251)45 00 (251)432-6533 (20b)941-1803(FAX) (2581340-059(FAX) (251)479-2593(FAX) (251)432-8599(FAX Big Sky Environmental, LLC February 16, 2022 • A list of other approved alternate disposal locations for this material from said generator that could have been utilized in light of the NOV and cessation of operation of the railyard, and • Similar information for any additional shipments that may currently be in transit to the Big Sky facility (including anticipated date of receipt and steps that have been taken by Big Sky to divert shipment in order to comply with the current NOV). • A list of any other rail shipments of solid waste (including waste type and volume, generator, generator location, and anticipated arrival date) that are known or suspected to be currently enroute to Big Sky.
